The PSCA Zoning Committee reviewed the following cases at its October meeting. Results are below.

1535 S. 11th Street: 

Application for the first story addition to an existing attached structure (max. height not to exceed 38’-0”) for use as an eating & drinking establishment (sit-down restaurant) at 1st floor level with accessory storage at basement, and a single family dwelling unit located at upper level with accessory rear roof deck located at second (2nd) story roof.  Zoning refused because the proposed use of an eating & drinking establishment is not permitted in this zoning district. 6 votes of non-opposition; 2 votes of opposition. Provisos include venting for oven/range must vent up through the building; railing on deck should allow light to pass through. Owner explained this will be a BYOB with no more than 30 seats with operating hours no later than 10:00 or 11:00 p.m.  Trash to be stored in rear yard.  Might request waiver for ADA accessibility issues.  Some neighbor opposition to another restaurant opening on 11th Street.

 1203 S. Clarion Street: 

Application for the change in use from existing one story garage to a three story single family dwelling with one attached off street accessory parking slot inside the residence, and the use of a rooftop sundeck.  Zoning refused due the open area of lot and rear yard depth are under the minimum required amounts. This case was continued and will be re-scheduled at an upcoming zoning meeting.

 

The following cases have not received a formal refusal but they wanted to present their plan to the neighborhood for input from the community.

1) 1304-06 9th Street – El Zarape Restaurant from Passyunk and Morris signed a lease for this space and will present their plans.  Will present at a future zoning meeting once refusal is received.  Was told that the no parking signs, the ATM in the garage/on the sidewalk; the flashing ATM sign need to be removed.  Owner said he was willing to make the changes to this property.

2) 1235 Federal Street – Plans for adding a third floor and building 10 apartment units with 6 parking spaces (originally 10).  Will present at a future zoning meeting once refusal is received.  Was suggested to lower density from 10 to 8 units and have larger sized apartments; was suggested that third floor addition be set back 3 feet on the Annin Street side; Architect agreed to do a shadow study.

3) 1403-1409- Darien Street – Plans are for the construction of 6 single family homes. Will present at a future zoning meeting once refusal is received.  Original plan was for seven 4-story townhomes.  Revised plan is for three 3-story homes and three 4-story homes to total 6 homes.  It was suggested that pilot house should be set back 5 feet and the 4th floor should be set back 8 feet.
