The PSCA Zoning Committee reviewed the following cases at its December meeting. Results are below.

1149 S. 12th Street (at Ellsworth Street):  

Application is for a take-out restaurant on the 1st floor front with an existing bi-level apartment from 1st floor rear to 2nd fl. rear; one apartment on 2nd fl. front; and one apartment on 3rd fl. total 3 family dwelling in an existing structure.  Zoning refused due to use as take-out restaurant is prohibited in this zoning district.  7 votes non-opposition.  Will be open 7 days a week hours 6-7 am to 10-11 ppm.  Trash pick up to occur during business hours; two trash cans will be outside during business hours, stored inside after hours.  Will eventually apply for outside seating but that was not included in this refusal.

1122 S. 13th Street:  

Application for the creation of 1 off-street surface sub-compact parking space in the rear yard with a 7’ 0” fence gate accessory to an existing attached single-family dwelling; alterations to accommodate parking access, add curb cut to a side access parking space.  Proposed use is not permitted in this zoning district.  7 votes non-opposition.  Streets Department already approved curb-cut; no legal parking currently on this rear street; owners will have a non-roll up gate to be flush with property.  

1439, 1441, 1443, 1445, 1447 Beulah Street:  

Application for the construction of 5 attached three story single family dwellings with cellar and roof deck with enclosed roof access stair and a front deck at 3rd floor.  Refused due to required open space of 30% of lot size is 202.5 square feet and the proposed size is 135 square feet.  7 votes non-opposition.  Pilot house to be at rear; 5 foot deep yard with 5 foot deep alley behind will help with open space of the homes.

1304 9th Street through to Passyunk Ave.:

Application for a take-out restaurant with seating on the ground floor and 1 apartment above.  Refused to use as a take-out restaurant with seating.  7 votes non-opposition.  Some neighbor concern/input.  Owner to remove ATM and replace roll-up security gate with a see-through security gate; business hours to be from 11 a.m. to 10 p.m. during the week and 11 a.m. on weekends.  Awning/Sign to be turned on only during business hours and it must not flash/blink; removal of ATM signs and no-parking/tow sign.  Landlord also to make sure tenants remove flag/banners from window. No outdoor seating is being sought at this time.

Standard Construction Provisos: 1. Heavy construction to be conducted Mondays through Fridays from 8:00 a.m. to 5:00 p.m. and no heavy construction on week-ends; 2. Daily removal of all trash from the property; 3. Lighting should be provided at both the front and rear of the property.

Joint Civic Meeting with South Broad St. Neighbors  on December 17th  has been postponed to Tuesday, January 21st @ 7:00 p.m. @ Methodist Hospital Morgan Conference Room regarding 1123-25 S. Broad St.  Application of a check cashing & Pawn broker services and retail sale of consumer goods on the 1st floor in the same building with a church and an administrative office.  Proposed use is prohibited with 500’ of a residential area.

The Zoning Committee does not make final decisions on the applications, but it does send letters to the Philadelphia Zoning Board Administration.
